    ORDER OF THE BOARD (by N.J. Melas):
    On August 15, 2000, petitioner DeKalb Sanitary District filed a petition for an adjusted standard from 35 Ill.
    Adm. Code 302.208(e) as that Board regulation pertains to acute and chronic levels of copper in its effluent and in
    the receiving stream at the outfall of its wastewater treatment plant.
    Also on August 15, 2000, the Board received a motion to appear
    pro hac vice
    from petitioner’s attorney
    Stephen N. Haughey. Haughey is licensed to practice law in the State of Ohio, the United States District Court for
    the Southern District of Ohio, and the Sixth Circuit Court of Appeals. Haughey is a member in good standing of the
    Ohio Bar. The Board allows Haughey to appear
    pro hac vice
    .
    Pursuant to Board regulations, petitioner caused timely publication of the required notice on August 26,
    2000, in the DeKalb
    Daily Chronicle
    . Petitioner then timely filed a certificate of publication with the Board on
    September 14, 2000. See 35 Ill. Adm. Code 106.711 and 106.712. Since hearing has been waived, the Board will
    defer action in this matter until receiving a response from the Illinois Environmental Protection Agency.
