ORDER OF THE BOARD (by B. C. Flemal):
On February 15, 1989, Fansteel/Escast, Inc. (“Pansteel”)
filed a Petition for Review of the Illinois Environmental
Protection Agency’s (“Agency”) denial of authorization under
Section 39(h) of the Environmental Protection Act (“Act”) for
Fansteel to dispose of its sodium hydroxide wastestream at
Browning—Ferris Industries’ disposal site. In addition to the
Petition, Fansteel filed a motion for stay pursuant to Section
16(b) of the Administrative Procedure Act (“APAT’). On March 9,
1989 the Agency filed its response in opposition to Fansteel’s
motion for stay.
The Board requires further information in order for it to
determine whether Fansteel’s activity falls within the Section
16(b) stay provision. Specifically, Fansteel shall provide the
Board with a copy of its prior permit and inform the Board
whether the waste has been previously disposed of pursuant to the
terms and conditions of the permit. Filings are due on or before
March 20, 1989.
