INTERIM ORDER OF THE BOARD (by R. C. Flemal):
This matter is before the Board upon an enforcement action
brought by Complainants filed November 9, 1987. Complainants
allege that Respondent, Archer Daniels Midland Company (“ADM”) at
its cogeneration plant in Decatur, has violated the Act and Board
regulations for noise pollution.
Hearings were held August 5 and 29, 1988. During hearing,
Complainants requested the Board to order Respondent to 1)
install silencers on its pipes during cleaning, 2) install
silencers on the stacks, 3) install silencers on all steam vents
vented into the atmosphere which provide 50 decibels of noise
reduction, and 4) that the installation be done by November 1988.
Also at hearing, Respondent stated that silencers were already
ordered and should be in operation by November 1988.
Thus, the Board requests a status report from Complainants
stating whether the noise still persists and whether they wish to
continue this action or to dismiss it. Also, the Board requests
a status report from Respondent ADM of the progress it has made
in installing silencers on pipes during cleaning, on the stacks,
and on all steam vents vented into the atmosphere, which provide
50 decibels of noise reduction. The status reports are due on or
before March 31, 1989.
