On December 16, the Trojan Corporation
responded to the Board~sNovember

1988 request for more information by filing
an amended petition for
variance.
The Board
notes that the amended petition fails to correct the
deficiencies
in the original
petition and therefore the Board
refuses to
accept the amended petition
as
a petition for variance.
The information
requested
is necessary to ensure that the Petitioner
is prepared to present
a
case at hearing
and to allow the Agency to prepare for hearing and to prepare
a useful
recommendation.
Unless
an amended petition
is filed within
45 days
of the date of the Order of November 29,
1988,
curing the noted defects, this
matter will
be subject
to dismissal, pursuant to
35 Ill. Adm. Code 104.125.
When
a sufficient amended petition has been received by the
Board, the
statutory decision deadline will restart.
