CONCURRING OPINION (by B.
Forcade):
On page four of the Opinion,
the majority declines
to accept
language offered by the Illinois Environmental Protection Agency
and the Department of Energy and Natural Resources that would
have established detailed information requirements for the filing
of site-specific regulatory proposals.
I would have included
such requirements.
Since most Board denials of site—specific regulatory
requests are based on failure to provide enough information to
determine what the impact
of the rule change would be,
I believe
we should have provided as much guidance as possible to the
regulated community on what types of information the Board would
like to see.
