ORDER OF THE BOARD

This matter comes before
the Board upon an April
4,
1989
proposal for rulemaking filed
by the Chicago Lung Association
(Association).
The Association submitted
a proposed rule to set
limits on the volatility of gasoline.
On April
6,
1989, The Board adopted an Order noting that
additional information would be required before the Board
could
accept
the proposal for hearing.
On April
13,
1989,
the
Association
responded to the Board’s April
6 Order.
The
Association filed
a proof of service upon the Illinois
Environmental Protection Agency and upon the Department of Energy
and Natural Resources
(Department).
Also,
the Association stated
its belief that there
is adequate
information
in the record,
or
which can be introduced
at hearing,
to address the issue of
the
economic impact of the proposed
rule.
Therefore,
the Association
recommends
that a formal economic impact study
(EcIS)
need not be
prepared by the Department.
The Board hereby accepts the proposal for hearing.
The
Board directs
the Hearing Officer
to establish a hearing
schedule, which may include
a schedule for
the pre—filing of
materials to be presented at hearing.
Pursuant
to Section 27(a)
of
the Environmental Protection
Act
(Act), within 21
days of the date of this Order,
any person
may request the Board
to determine that an EelS should or should
not
be prepared.
Such requests are to be made in writing and
must “detail the reasons for the request and describe,
to the
extent reasonably practicable,
the economic impact of the
proposed rule”.
