INTERIM ORDER OF THE BOARD

On August
2,
1988,
in each of the above captioned cases,
E
&
E Hauling Company
(“E
&
E Hauling”)
filed a petition
for
review
of an administrative citation
issued by the County
of DuPage,
on
July 18,
1988, pursuant
to authority delegated by the Illinois
Environmental Protection Agency
(“Agency”).
On December
30,
1988,
the Board received the transcript
for
a combined hearing
held on December
8,
1988 for both of these matters.
At hearing,
the parties
agreed to
a briefing schedule allowing the Agency
attorney (apparently participating as lead counsel)
to submit
a
brief
three weeks after
receiving
a copy of the hearing
transcript and allowing
E
& B Hauling
to submit
its brief three
weeks thereafter.
To date,
over three months
later,
no briefs have been
submitted and no motions have been filed.
Since the three week
deadline to submit
the briefs has long since passed,
the Board,
on its own motion,
hereby orders that the Agency submit
its
briefs by May 8,
1989 or be subject
to sanctions,
including
dismissal
of these cases.
