OPINION AND ORDER OF THE BOARD

This matter
comes before the Board
on its own motion
to
accomplish two purposes.
First,
the Board
is proposing
to correct
35
Ill.
Adm.
Code
201.405, which was the subject of a previous Board rulemaking
proceeding,
R87—38.
After fulfilling
the rulemaking requirements
of the Illinois Administrative Procedure Act
(APA),
the Board
adopted Section
201.405 on December
15,
1988.
In the Board’s
final Order, Section 201.405 consisted of five subsections,
(a)
through
(e).
However,
the Board’s submission of the adopted
rules
to the Secretary of State was incorrect.
Although the
Illinois
Register copy correctly
set forth Section 201.405,
the
official Secretary of State’s file copy inadvertently omitted
subsections
(a) and
(b).
Thus,
the official copy
of Section
201.405 does not correctly represent
the substantive provisions
agreed upon by the R87—38 joint proponents
and thereafter
adopted
by the Board.
The purpose
of
the instant rulemaking proceeding
is
to correct the official
copy of Section 201.405
to accurately
represent
the Board’s
intent
in R87—38.
To accomplish
this
purpose,
the Board
is
required under
the Secretary
of State’s
rulemaking procedures,
specifically

Ill.
Adm.
Code 100.240(d),
to repeat the
regular
rulemaking process.
Thus,
the Board
is
today proposing
for First Notice
the true and correct version
of
Section
201.405.
For purposes
of
a complete
record,
the Board
hereby incorporates the record
of R87—38 into this docket.
Second,
the Board
is proposing
to
repeal
35
Ill.
Adin.
Code
230 and 231
in their entirety.
Part 230 constitutes
the Board’s
New Source Performance Standards
(NSPS) adopted
by peremptory
rulemakings between 1979 and 1987.
Part 231 constitutes
the
Board’s adoption of the National Emission Standards
for Hazardous
Air Pollutants
(NESf-1APS)
also by
peremptory
rulemaking
between
1980 and 1987.
Prior
to
1987,
the Board was required
to adopt
the NSPS
and NESHAPS provisions
in order
for them
to be
enforceable
in Illinois.
However,
in 1987, Section
9.1
of
the
Environmental Protection Act
(Act) was amended
to cause
the

automatic enforceability
of the NSPS and NESHAPS provisions
in
Illinois.
As
a result,
the Board
is no longer required
to
formally adopt NSPS and NESHAPS provisions
to make them
effective;
the NSPS and NESHAPS become effective immediately upon
their adoption by the United States Environmental Protection
Agency (USEPA).
The problem remains, however,
of what
to do with
the
existing regulations embodied within Parts 230 and 231.
These
regulations are no longer necessary to keep on the books.
In
fact,
as new NSPS and NESHAPS are adopted
by USEPA and become
enforceable
in Illinois pursuant
to Section 9.? of
the Act,
these
existing
regulations may become outdated,
or worse, may be
inconsistent with
the updated standards such as
to cause
confusion
to
the regulated community.
The Board believes that
the wisest course
is
to simply repeal all
of Parts
230 and 231.
This action
is
not intended to and does not cause any substantive
amendment
to the existing universe of NSPS and NESUAPS provisions
enforceable under Section 9.1
of the Act.
The Clerk
is hereby directed
to submit the following
revisions
to the Illinois Administrative Code
to the Secretary
of
State
for
First Notice publication
in the Illinois Register.
The
Hearing Officer
is
directed
to schedule and conduct public
hearings without delay.
Pursuant
to Section 27(a)
of the Act,
within
21 days
of the date of this order,
any person may request
the Board
to determine
that an economic impact study should or
should not be prepared.
Such request shall be made
to the Board
in writing and shall detail the reasons for the request and
describe,
to the extent reasonably practicable,
the economic
impact
of
the proposed
rule.
