ORDER OF THE BOARD:
This matter comes before the Board upon a June 15,
1989
filing of an Administrative Citation pursuant
to Section 31.1 of
the Illinois Environmental Protection Act
(Act)
by the County of
DuPage.
A copy of that Administrative Citation is attached
hereto.
Service of the Administrative Citation was made upon Sal
and Dawn Kruzinski on June 12,
1989.
The County of DuPage
alleges that Sal and Dawn Kruzinski has violated Section 2l(q)(l)
of the Act.
The statutory penalty established
for this violation
is $500.00 pursuant to Section 42(b)(4)
of the Act.
Sal and Dawn Kruzinski has not filed a Petition for Review
with the Clerk of
the Board within
35 days of the date of
service
as allowed by Section 31.l(d)(2)
of the Act.
Therefore, pursuant
to Section 31.l(d)(l), the Board finds that Sal and Dawn
Kruzinski has violated the provision alleged
in the
Administrative Citation.
Since there
is one
(1)
such violation,
the total penalty to
be imposed
is set at $500.00.
It
is hereby ordered that, unless the penalty has already
been paid,
within
30 days of the date of this Order
Sal and Dawn

shall, by certified check or money order payable
to the

FACTS

That
Respondents,
Sal
Kruzinski
and
Dawn
Kruzinski, are the present owners of the property located at
109th
and Lernont
Road,
u-i
the County of
DuPage,
State
of
Illinois.
2.
That
said
property
is
a
residence,
with
a
storinwater ravine
located at
the southwest
corner of
the
property,
and said
site is
designated with
Site Code
No.
0430000000.
Said site
is commonly known
to the Agency
as
the property of Sal and Dawn Kruzinski.

That
Respondent
has
owned
said
property
at
all
times
pertinent
hereto.
4.
On
April
10,
1989,
a
drainage
complaint
was
filed
with
the
DuPage
County
Department
of
Environmental
Concerns,
identified
as
Drainage
Complaint
Number
89-10-038-5,
attached
hereto
and
made
a
part
hereof.
5.
That on
April
11,
1989,
Keith Trychta,
of
the
County of
DuPage,
in
response
to DuPage
County
Drainage
Complaint Number 89-10-038-5,
inspected the
above-described
property.
A copy of the Inspection Report setting forth the
results of such
inspection is
attached hereto
and made
a
part hereof.
VIOLATIONS
On the basis of
direct observations of Keith
Trychta,
the County
of DuPage
has
determined that
Respondent
was
conducting open dumping on the above—described property,
in
a manner which resulted in the following conditions:
1)
Littering in violation of Ill. Rev.
Stat.
(1985),
Ch.
111 1/2,
Par.
1021(q) (1).

Pursuant to Public Act 84-1320

subject to
a civil penalty of Five Hundred Dollars
