    ORDER OF THE BOARD (by M. McFawn):
    Pursuant to a motion to dismiss by the complainant, the Board dismisses this matter and closes the docket.
    The Board notes that on the first page of the filing, complainant requests dismissal with prejudice, while on the
    second page he requests dismissal without prejudice As a practical matter, following this dismissal the instant
    appeal cannot be reinstated at a later date, since any appeal must be filed within 35 days of the date of the Agency
    decision.
