On June
1,
1989, General Motors Corporation filed
an amended
petition
for variance restarting
the 120—day statutory decision
deadline
in this matter.
On November
30,
1988,
General Motors
Corporation filed
its original petition
for variance and the
Board set the matter for hearing.
However,
as
of this date,
the hearing officer has not set
the matter
for hearing
nor furnished
the Board with
the Hearing
Officer’s Scheduling Order
as directed
by the Board’s Order
of
December
15,
1988.
The Board orders
the hearing officer
to set
a hearing
and
if
the parties fail
to provide an acceptable hearing date or
if
after
an attempt
the hearing officer
is
unable to consult with
the parties, the hearing officer
shall unilaterally set a hearing
date,
and provide
a hearing officer’s scheduling order,
in
conformance with the schedule outlined
in the Board’s Order
of
December
15, 1988.
