This matter
comes before the Board upon
a Motion to Dismiss
filed by complainant, People of the State of Illinois on June
12,
1989.
Complainant
filed an Administrative Citation pursuant to
Ill. Rev. Stat.
1987,
ch.
111 1/2, par.
1031.1 on January
23,
1989.
A hearing was held on June
9,
1989 at which time
complainant moved to dismiss this matter.
Respondent did not
appear at the hearing.
Complainant states
in its petition that
an inspection of respondent’s land on May
12, 1989 revealed that
respondent had complied with the agreed clean up of the site.
This matter
is dismissed.
However,
the Board notes
that
hearing costs have been incurred by the Board in this cause which
could have been avoided.
The expenditure of such unnecessary
costs should be avoided in the future.
