BOARD

This matter
is before the Board on
a December
7,
1989 motion
to amend complaint on its face filed by the Illinois Environmental
Protection Agency.
In support of its motion the Agency states that
the
“allegation with
respect
to
‘refuse
in
standing
or
flowing
water,
is not sustainable.”
The Agency requests that this count
be
stricken
and that
the
civil penalty
be
reduced
to an
amount
consistent with the amended complaint.
The Agency further states
that
the
Respondent has agreed to remit the civil penalty
to the
Agency
upon
the entering
of
an Order
amending the
complaint
as
requested
in this motion.
The
Board
hereby
grants
the Agency’s
motion
to
amend
the
complaint.
