This matter
comes before
the
Board on
a motion for expedited
decision filed on behalf of the petitioners on July 7,
1989.
The
petitioners are seeking a variance under
the Board’s
regulation
in
35
Ill.
Adm. Code Section 237.103 to allow the open burning of
explosive waste.
The motion states that the petitioners are not
presently burning their wastes and will not do so until the
variance
is granted.
The petitioner maintains that this causes
unnecessary expense and presents safety hazards greater than
those that occur
if
variance was granted.
The Board notes
that the transcripts of the hearing for this
matter were received by the Board on July 10, 1989.
Therefore,
the record is now complete and the case
is ready to be decided by
the Board.
In response to the petition for expedited decision,
the Board hereby agrees to endeavor
to expedite the decision
making process
in this matter and will issue
the Opinion and
Order
at the earliest possible date.
