ORDER OF THE
BOARD

On June
23, 1989,
Acme Steel Company
(“Acme”) filed an
agreed motion for stay of proceedings, and a waiver until
November
2,
1989.
The Board notes that November
2,
1989 is 112
days from today.
Since that is less time than is normally
required for actions of this type,
the Board cannot grant a
stay.
The Board also notes
that this 1987 case has not yet gone
to hearing.
Also,
the two previously scheduled hearings have
been cancelled after notice of hearing has been published; this
misinforms the public and wastes Board resources.
The Board directs the hearing officer
to schedule
a hearing
within 14 days and complete such hearing within 60 days.
This
schedule may be extended only if Acme provides
a sufficient
waiver
of decision deadline to allow ample time for any stay and
reasonable Board hearing and decision.
The Board also directs
the hearing officer that once notice of any future hearing has
been published,
such hearing shall proceed absent emergency or
extreme circumstances.
The motion for stay
is denied.
