ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a January LU, 1990
Objection and Motion to Strike and Motion for Application of
Section 28 Rulemaking Procedures filed by the Stepan Company. On
Janaury 23, 1990, the Illinois Environmental Protection Agency
(Agency) filed a Motion for Extension of Time to Respond. The
Agency states that it has been, and expects to continue, to
participate in an effort to resolve the many issues regarding the
interpretation of Section 28.2 of the Environmental Protection
Act (Act). The Agency requests an extension until February 9,
1990 to respond to Stepan’s motion. On January 24, 1990, a
Motion to Dismiss or Sever Proposed Changes to the Generic Rule
and SOCMI Leaks Rules was filed by the Illinois Environmental
Regulatory Group, the Illinois State Chamber of Commerce, the
Illinois Manufactuters Association, the Chemical Industries
Council of Illinois, the Illinois Petroleum Council, and the
Illinois Steel Group (“the Industry Group”).
Although the Board is concerned about the time frames within
which this rulemaking is supposed to proceed, the Board believes
that a resolution of the many issues regarding Section 28.2 by
the participants will do much to enable the Board to meet the
schedule set forth in the Board’s First Notice Opinion. The
Agency’s motion is therefore granted.
