to dismiss petition for variance.
That motion
is granted
and this matter
is dismissed.
The Board notes that once a permit
appeal
is dismissed,
that any refiling
is time—barred,
as
the
Illinois Environmental Protection Act requires that any appeal be
filed within
35 days of the Illinois Environmental Protection
Agency’s permit decision.
