ORDER OF THE BOARD (by B. Forcade):
On July 6, 1990, Borden Chemicals and Plastics Operating
Limited Partnership filed a petition for extension of a prior
variance, PCB 88—90, which expires on October 6, 1990. On August
17, 1990, the Board received an objection to the grant of
variance. This matter is accepted for hearing. The hearing
officer is required to inform the objector of the hearing
pursuant to 35 Iii. Adm. Code 104.200(b):
The Hearing Officer shall give notice of the
hearing in accordance with 35 Ill. Adm. Code
103.123(b), at least 21 days before the
hearing to the petitioner, the Agency, and
anyone who has filed an objection to the
petition.
The Board notes that there are extremely tight timeframes in
this proceeding. The decision deadline in this matter is
November 3, 1990. The last regular Board meeting to decide this
matter is October 25, 1990. The hearing is presently scheduled
for October 4, leaving 16 working days to receive the transcript
and draft an Opinion and Order. Therefore, the hearing, as
established by the hearing officer, may not be rescheduled
without waiver of decision deadline; transcript of hearing will
be expedited; and no written briefs will be allowed prior to
Board decision. Any deviation from this schedule must be
accompanied by a waiver of decision deadline.
