This matter comes before the Board upon an August 6, 1990

Motion to Stay Pending Appeal filed by the Illinois Environmental

Protection Agency (“Agency”). The Agency requests that the Board

stay its April 26, 1990 and June 21, 1990 Orders oending

resolution of the Agency’s appeal to the Illinois Appellate

Court, Second District. No response has been filed on behalf of

Calvary Temple Church.

In accord with the Board’s customary practice, the Motion

for Stay is denied. The Agency is free to seek a stay from

the

Appellate Court.
