ORDER OF THE BOARD (by J. Marlin):
On September 28, 1989, Moline Corporation (Moline) and the
Environmental Protection Agency (Agency) filed a Joint Motion to
Stay Proceedings. In the motion the parties state that they have
“reached an agreement to pursue negotiations in an effort to
settle this matter”. As a result, the parties request “the Board
stay all pending proceedings until further notice from any of the
parties”.
Since this is a permit appeal proceeding, the Board must
make its decision in this matter within the statutorily
prescribed time period. Specifically, the Board is due to decide
this case at its January 11, 1990 meeting. Moline has not
provided the Board with a waiver of that statutory decision
deadline. Therefore, the Board will not grant this motion.
However, the parties are free to refile their motion if it is
accompanied by an appropriate waiver.
The joint motion is hereby denied.
