On October
2,
1989, the City of Ottawa
(“Ottawa”)
filed a
motion
for modification of Board Order.
Ottawa
requests the
Board modify Condition
1 of
its August
4,
1988 Order.
Condition
1 states:
1.
The City will prepare an operational plan for
and make modifications
to its sewer
system, as
specified in the petition,
by October
1,
1989.
Thereafter, an annual report detailing
performance of the specified activities
will
be
submitted to the Agency by January 31st of each
year.
Ottawa requests the Board grant
a five month extension to the
October
1,
1989 deadline
for preparation of an operational plan
(to March
1,
1990),
and
a nine month extension to the October
1,
1989 deadline for making modifications
to its sewer system (to
June
1,
1990).
Ottawa does not request any change
in the
schedule for submitting
the annual report to the Agency by
January
31 of each year following the preparation of the
operational plan and the making
of modifications
to its sewer
system.
No changes were requested concerning the other
conditions and deadlines as specified
in the Board’s August
4,
1988 Order.
On October
18,
1989,
the Agency filed
its response
indicating that it does not oppose the requested relief
as long
as Ottawa’s deadline
for making modifications to its sewer system
does not extend more than nine months beyond the current deadline
of October
1,
1989.
Ottawa gives several reasons for its request.
These are the
discovery of excessive infiltration and inflow after
installation
of certain sewers which required extensive field investigations,
the receipt of a report from the U.S. Army Corps of Engineers
involving the construction of
a dyke which necessitated
modifications of the proposed manhole and sewer rehabilitation,
necessity for additional flow monitoring, construction of

additional sewers to eliminate overflow #16,
the later—than—
anticipated issuance of general obligation bonds,
and delays
experienced in receiving Agency approval for modification of
Ottawa’s existing sewer use ordinance to prohibit downspouts and
other sources of inflow into the combined sewer system.
Ottawa states that completion of the draft operational plan
is expected in the next six weeks.
Ottawa further states that
additional time
is needed for staff and Agency review of the
plan.
Ottawa states that it has prepared plans and
specifications for a significant portion of the required sewer
system modifications, and that a construction permit application
was submitted to the Agency on September
6,
1989.
A construction
permit for the remainder of the modifications will be submitted
to the Agency
in the near future.
The Board
finds Ottawa’s motion to be reasonable and that
the requested extension will not alter
the final completion of
Ottawa’s sewer separation program.
The Board hereby grants
Ottawa’s motion for modification of Board Order.
Ottawa shall
prepare an operational plan for modifications
to its sewer
system, as specified in the petition,
