This matter
comes
before the Board upon
a August
7,
1989,
motion
for modification
of a Board
Order,
filed
by the City
of
Belleville.
On
September
14,
1989,
the
Illinois
Environmental
Protection
Agency
(Agency)
filed
its
response
to
Belleville’s
motion.
After discussing the positions set forth by Belleville and the
Agency
in
its Order
of
September
28,
1989,
the Board
requested
information on tne status of the federal court action.
Responses
to this request were timely filed by Belleville on October 10, 1989
and by the Agency on October 13,
1989.
Apparently,
no settlement
agreement has been reached
as yet,
and a trial date has been set
for early
1990.
In addition,
the Agency
states that it does not
want the Board’s Order of November 19, 1987, “mandating an outdated
project,”
to
delay
prompt
compliance.
The
Agency
states
that
resolution of this modification request will only reduce the issues
to be litigated in the enforcement case.
The City of Belleville’s motion is hereby granted.
The Board
amends
its
November
19,
1987,
Order
granting
Combined
Sewer
Overflow Exception to
include the attached Municipal
Compliance
Plan
(MCP) Project Schedule (Revised July 1989), which
is attached
to Belleville’s August
7,
1989 motion.
