ORDER OF THE BOARD

This matter comes before the Board on a November
6,
1989
motion to dismiss filed by
the County of Tazewell and the
Tazewell County Board of Health (“Tazewell”).
In support of
its
motion Tazewell states that Respondent, Dan Koch, was not
responsible
for the dumping of tires on his property and that
“Respondent burned the tires
after seeking advice from
a County
Board member and the local
fire department.”
Tazewell further
states
that the Koch property has been cleaned up and that
continued prosecution
is not
in the best
interest of
the
public.
The Board hereby grants Tazewell’s motion and this
matter
is dismissed.
