(by J. Theodore Meyer):

I

concur

in

the

actions

taken

by

the majority

today

in

refusing to modify this rulemaking in response to the objection by

the Joint Committee on Administrative Rules

(JCAR),

and in adopting

the rules.

Although

I recognize

that the

issues

discussed

in

JCAR’s objection are legitimate problems with the rule as adopted,

I am very aware that this rulemaking is promulgated in response to

a deadline established by the United States Congress in the Clean

Water

Act.

I

believe

that

it

is

very

important

to meet

that

federal deadline,

and thus

I voted in favor of proceeding with the

rule as previously proposed.

For those reasons,

I concur.
