ORDER OF THE BOARD

This matter comes before the Board upon
a letter
received on
September
1,
1989 from the hearing officer
in this matter.
The
hearing officer’s letter refers the Board to
a motion
to compel
filed by the Complainants on June
30, 1989.
In response to the Complainants’ motion to compel,
the
respondent
filed
a motion
for continuance on July
14,
1989.
The
respondent’s motion for continuance requested until August
14,
1989 to obtain an attorney and respond to the Complainants’
motion to compel.
In an amended hearing officer scheduling order
of July 19,
1989,
the hearing officer granted respondent’s motion
for continuance and directed that respondent’s attorney file an
appearance with the Board by August
14,
1989.
The hearing
officer also allowed the respondent until September
8,
1989
to
respond to the Complainants’ motion
to compel.
At this
time the respondent’s attorney has not filed an
appearance
nor has
the
respondent responded
to
the motion to
compel.
As such,
the respondent
is currently
in violation of the
hearing officer’s July
19, 1989 Order by not complying with the
August
14,
1989 and the September
8,
1989 deadlines.
The Board will rule upon the Complainants’ motion to compel
in this matter.
The Board will allow respondent
10 days
to file
an appearance by their attorney and respond to the motion
to
compel as stated
in respondent’s motion for continuance.
These
filings must be received by the Board on or before September 25,
1989.
The Board will consider Complainants’ motion to compel
after September
25,
1989 whether
or not such filings are
received.
