response to the motion.
On August
29,
1989,
the respondents
filed
a Cross—Motion for
Summary Judgment.
Also on that date, Kerr—McGee Chemical
Corporation filed a Counterclaimant’s Motion for Summary
Judgment.
On August
31,
1989, Lefton filed
a motion seeking an
extension of time
to respond
to the August
29,
1989 motions.
That motion
is granted, and Lefton’s response shall
be filed
by
September
15,
1989.

The Board will defer ruling upon the August
11,

so that it can rule upon all three motions for summary judgment
at the same time.
