This matter is before the Board on a January 17, 1990 motion
for expedited decision,
filed by petitioner Borden Chemicals
and
Plastics Limited Operating Partnership (Borden).
Borden asks the
Board to expedite its decision
in this site-specific rulemaking.
Borden notes that it is currently operating under a variance from
the water quality standards for total dissolved solids
(TDS)
and
chloride.
Those
standards are also the subject
of the instant
rulemaking.
The variance
expires
on
October
6,
1990,
or upon
conipletion of the rulemaking, whichever comes first.
Borden state
that
it wishes
to
avoid
the need to
file another petition
for
extension
of the current variance,
and therefore
asks
that the
Board expedite its decision in this rulemaking so that the matter
may
be
resolved
before
the
October
6,
1990
expiration
of
the
variance.
Borden’s motion for expedited consideration is granted,
and the Board will act upon this rulemaking as quickly as possible
consistent with the demands of its caseload.
