This matter
is now before the Board on Illinois Environmental
Protection Agency’s
(Agency) Response to Board Order
of December
20,
1989 (Response).
The Agency’s Response contains language the Board
construes,
in the interest of administrative efficiency,
as a Motion
to Dismiss this action conditioned upon relief from the Board’s prior
Default Order.
The Board’s review of the Response reveals that
just cause exists
to vacate the Board’s default order of November
15,
1989.
Upon
reconsideration,
that Board Order
is hereby vacated.
The Motion to
dismiss
is therefore granted and this action
is hereby dismissed.
