ORDER OF THE BOARD (by B. Forcade):

This matter comes before the Board on a Motion for Extension

of Time to Complete Construction of An Earthen Berm filed by

Gallagher Asphalt (‘Gallagher”) on July 27, 1990. Pursuant to

the Final Opinion and Order of the Board issued on July 19, 1990,

Gallagher was directed to construct an earthen berm by July 27,

1990. Gallagher has indicated “that they intend to complete the

earthen berm promptly.” See Motion p. 2. Gallagher requests an

extension of time until not later than September 27, 1990 to

complete construction of the berm. Gallagher expects that

completion will occur prior to that date.

The motion is granted. Gallagher is ordered to proceed

immediately with the construction of the earthen berm and to

complete such construction not later than September 27, 1990.
