By Order

1990, the Board requested the parties to
present their views on how to proceed in this matter.
This is
a
permit appeal,
in which on March
9,
1990 the Fifth District
Appellate Court reversed and remanded the Board’s March
5,
1987
decision.
The Board received two responses,
one filed by Wells
on July
27, 1990, and one filed on behalf of the Agency on August
3,
1990.
The Board has also received three letters of comment on
July 25, July 27 and August
8 from non—parties.
In reviewing these filings, the Board cannot be certain as
to who is presently authorized to represent the Agency’s views,
given the age of the case.
Additionally, neither filing presents
a legal analysis explaining how the suggested course of
proceeding is consistent with, and
in furtherance of,
the
Appellate Court’s mandate.
The parties are requested to make appropriate filings
responsive to this Order
to be received by the Board on or before
September
30, 1990.
