    ORDER OF THE BOARD

    C. Marlin):
    This matter
    is before the Board on a status report requested
    by the Board on July
    3,
    1990.
    The Petitioner’s status report was
    received by the Board on July
    30,
    1990, and indicated
    that
    Petitioner would submit
    a permit application with the Agency
    during the week of July 30,
    1990.
    The Illinois Environmental
    Protection Agency (Agency) filed a report which was received by
    the Board on August
    6,
    1990,
    indicating that
    it had not received
    the permit application prior
    to submitting
    the status report.
    This
    is the second status report the Board has requested in
    this case over the last few months.
    Each report has indicated
    that
    the parties are negotiating towards settlement;
    however,
    a
    settlement has not been reached.
    This permit appeal was
    orginally filed with the Board on October
    25, 1985.
    Thus,
    this
    proceeding has been before the Board for over
    5 years;
    therefore,
    the Board directs the Hearing Officer
    to schedule this matter
    for
    hearing
    no later
    than September
    10,
    1990 and
    to complete such
    hearing
    no later
    than November
    1,
    1990.
