This matter comes before

the Board on a February

motion to amend complaint on

its face instanter

filed by

the

Illinois Environmental Protection Agency

(Agency)

.

In support of

its motion

the Agency states that after negotiations and remedial

action,

the Agency has agreed to amend

the complaint.

The Agency

requests

that the violation at Paragraph A(2)

be deleted and the

civil penalty be amended

in accordance.

The Agencyts motion

is granted.

The complaint shall

be

amended to include only the violation

in Paragraph A(l)

and the

civil penalty shall

be reduced

to $500.00.

Unless respondent

moves

to dismiss

their Petition for Review and remits the civil

penalty,

this matter shall proceed

to hearing.
