ORDER OF THE BOARD (by B. Forcade):
On November 16, 1989, Archer—Daniels-Midland Company (“ADM’~)
filed a Joint Motion to Remand to the Illinois Environmental
Protection Agency (“Agency~). That motion is granted. This
constitutes final action by the Board and this proceeding is
closed.
The Board notes that notices of hearing have been published
on four occasions (October 14, 1988; January 30, 1989; June 1,
1989; and October 3, 1989). None of those hearings ever took
place. In any future proceedings the parties are encouraged to
address the conflict in a way that does not result in unnecessary
noticing, scheduling, and cancellation of hearings.
