On May 7,
1990,
the Illinois Environmental Protection Agency
(“Agency”)
filed an Agency Response to Board Order of April 12,
1990.
The Board, on its own motion, hereby orders both parties
to submit more information concerning this matter.
The
Respondent
is ordered to reply to the Agency’s response.
The
Agency is ordered to provide clarification of the following:
This violation occurred on April
7,
1989, well before
the Agency instituted its new procedures for avoiding
confusion in Administrative Citations.
How is this
matter distinguishable from violations that occurred
during the same time frame which were dismissed after
subsequent cleanup after
a default order was issued?
Both replies are to be filed with the Board on or before
June 18,
1990,
in order that the Board may consider this matter
at its June 21,
1990 meeting.
