    This matter comes before
    the Board upon
    a complaint filed
    October
    6,
    1989
    on behalf
    of the Illinois Environmental
    Protection Agency by and through
    its attorney, Neil
    F.
    Hartigan,
    Attorney General of the State of Illinois.
    The complaint alleges
    that Respondent,

    Dillon Limestone,
    Inc.
    (“Dillon”),
    has
    violated Sction 9(b)
    of the Illinois Environmental Protection Act
    (“Act”),
    Ill.
    Rev.
    Stat.
    1987,
    ch.
    1111/2,
    par.
    1009(b),
    and
    35
    Ill.
    Adin. Code
    201.143 of the Board’s rules
    and regulations.
    Hearing
    on
    this matter was held
    on January 11, 1990
    in
    Stockton,
    Illinois.
    At the hearing,
    the parties
    submitted
    a
    Stipulation
    and Settlement Agreement,
    executed by the parties.
    The Stipulation sets forth
    the facts
    and proposed
    terms of
    settlement
    in this matter.
    Dillon admits
    to past violations
    of
    Section 9(b)
    of the Act and
    35
    Ill. Adm.
    Code 201.143
    and agrees
    to pay
    a civil penalty of
    $1500.
    Dillon farther agrees
    to cease
    and desist
    from the alleged violations.
    The Board
    finds
    the Stipulation acceptable under
    35
    Ill.
    Adm. Code 103.180.
    This Opinion constitutes the Board’s findings
    of fact and
    conclusions
    of law
    in this matter.
    ORDER
    The Board accepts
    the Stipulation and Proposal for
    Settlement,
    which
    is hereby incorporated
    by reference
    as
    if fully
    set forth herein.

    Respondent shall pay the sum of $1,500 within 30 days of the
    this Order.
    Such payment
    shall be made by certified check or
