    AND WIRE COMPANY FOR HAZARDOUS

    (Site-Specific

ORDER OF THE BOARD BY (J. Anderson):
This matter conies before the Board on its own motion to
correct its Order of September 27, 1990 and with regards to the
transfer of the petitioner’s delisting petition and files from
the United States Environmental Protection Agency (USEPA) to the
Board. The State of Illinois was authorized to carry out its
hazardous waste delisting program in lieu of the Federal
delisting program on April 30, 1990. (55 Federal Register 7320,
March 1, 1990.) The USEPA has transferred to the Board those
delisting petitions which were filed with the USEPA before April
30, 1990 and which are still pending. These petitions have been
accepted by the Board and are construed as having been properly
filed with the Board through the transfer of jurisdiction from
    USEPA.
The delisting petition in the present case was filed with
the USEPA after April 30, 1990 when USEPA did not have
jurisdiction over delisting petitions for the State of Illinois.
Therefore, this delisting petition, although transferred from the
USEPA, is only now being properly filed with the agency with
jurisdiction to accept the petition. As such, the Board needs to
correct its September 27, 1990 Order which accepted the
transferred delisting petition and directed the petitioner to
supply the Board with certain information by October 17, 1990.
The Board hereby corrects its prior Order by adding that
petitioner needs to pay a filing fee of seventy—five dollars
($75.00) for the petition for site-specific rulemaking. (Ill.
Rev. Stat. 1989, ch. 111 1/2, par 1007.5 and 35 Ill. Adm. Code
101.120(b).) The petitioner has until October 23, 1990 to pay
the Clerk of the Board. The Board will also extend the date
petitioner’s response must be in the Board’s offices to October
    23, 1990.
