    ORDER OF THE BOARD
    (by J. Marlin):
    This matter is before the Board on a September 11,
    1990 motion
    to
    amend
    complaint
    instanter
    on
    its
    face
    filed by the Illinois
    Environmental Protection Agency (Agency).
    In support of its motion
    the Agency states that the parties have negotiated for the deletion
    of the alleged violations in Paragraphs A(3),
    A(S)
    and A(8).
    The
    Board
    notes
    that
    the
    Agency
    has
    asserted
    that
    the
    respondent
    will
    move
    to
    withdraw
    the petition
    for
    review
    upon
    granting of the Agency’s motion to amend the citation.
    The Board
    clearly
    states that the granting of the Agency’s motion
    is
    not
    dependent upon any motion of the respondent.
    The Agency’s
    motion
    is
    granted
    and
    the complaint
    will
    be
    amended to delete Paragraphs A(3), A(S), and A(8) from the original
    complaint.
