In support of its motion

the Agency

states that the alledged

open dump was

just west

of

respondent’s property

line,

the alledged open dump was caused by

unknown

third

parties,

and

despite

respondent’s

lack

of

culpability,

respondent cleaned up the site.

The Agency’s motion to withdraw

is hereby granted and this

matter

is dismissed.
