On July
16,
1990,
the Illinois Environmental Protection
Agency
(“Agencyt1)
filed a Motion for Leave
to File Statement of
Respondent Concerning
the Basis
for Permit Denial Instanter.
Olney’s petition
for a permit was denied by the Agency in October
of 1989 and that decision was appealed on November
1 of
th same
year.
The permit denial hearing is currently set for August
3,
1990.
Due
to the fact that
th hearing
in this matter
is only two
weeks away,
the Board will not grant
the Agency’s motion.
Instead,
the Board orders the hearing officer
to postpone the
August
3, 1990 hearing date so that Olney will have an
opportunity to respond to the Agency’s motion and moreover,
so
that Olney will have adequate time to address
this new
information submitted by the Agency.
