ORDER OF THE
BOARD

On June
6,
1990, the Illinois Environmental Protection
Agency
(Agency) filed a request to extend the post-adoption
comment period in this matter for an additional 30 days,
from
June 25,
1990,
to July 25,
1990.
In support of its motion, the
Agency states that it will not be able to complete its review and
comments in this matter by the June 25, 1990 deadline because
many of its staff members are currently preparing,
coordinating,
and reviewing comments and questions for the June 26 and 28, 1990
EcIS hearings in R87-37
(cross-connections).
As the Agency itself notes, this is its second request for
extension in this proceeding.
The Agency also recognizes that
these regulations must be promulgated under Sections 7.2 and 17.5
of the Environmental Protection Act as soon as possible.
We do
note that,
for most all of the specific issues,
this is the
second time that the Board has requested comments.
However,
in
consideration of the Agency’s present workload and the impact of
this rulemaking, we will grant the Agency’s motion, but only
until July 17,
1990.
We note that we are reviewing whether the
delay in this particular proceeding might call for Board action,
at its June 21,
1990 Board meeting, requiring that another
“reasons for delay” notice be published in the Illinois Register.
(See Section 7.2(b)
of the Act.)
