ORDER OF THE BOARD

This matter comes before
the Board by the Agency’s June
14,
1990 Motion
for Reconsideration of the Board’s May 10,
1990 Final
Order.
The Agency presents
two issues
in
their motion:
1)
that
the word
“solids” was omitted
from the definition of
‘Transfer
Efficiency”
in the Final Order, whereas
it was
in place at Second
Notice; and
2)
that the Board should not have added alternative
test method language
in that
it may not be
federally approvable.
In regards
to the definition of “Transfer Efficiency”,
the
word “solids” was mistakenly omitted from the Final Order and
therefore this portion of the Agency’s motion
is granted.
The
Board regrets
the error and appreciates
the diligence of the
Agency in spotting the omission.
The Board intends to correct
this error and will do so by taking
it
to First Notice
in an
appropriate docket
in the shortest time practicable.
Insofar as alternative
test methods are concerned,
the Board
has considered
this
issue at length throughout the course of the
proceeding and stands by its determination.

Accordingly,
this aspect of the Agency’s motion
is
denied.
For
the reasons contained herein,
the Agency’s Motion for
Reconsideration
is granted
in part and denied in part.
