ORDER OF THE BOARD (by N.J. Melas, E.Z. Kezelis, M. McFawn):
On December 6, 2000, the Illinois Environmental Protection Agency (Agency) filed a
rulemaking proposal pursuant to Section 57.14 of the Environmental Protection Act (Act) (415
ILCS 5/57.14) (1998)) and 35 Ill. Adm. Code 102.121(b) of the Board’s procedural rules.
The proposed rulemaking would clarify and refine certain provisions of the Board’s
underground storage tank (UST) rules. The proposal would also add the contaminant methyl
tertiary-butyl ether (MTBE) as an indicator contaminant in gasoline.
The Board finds that the petition meets the minimum requirements of 35 Ill. Adm.
Code 102.160(a) and accordingly accepts this proposal for hearing. The Board directs the
hearing officer assigned to this matter to schedule hearings as required pursuant to Title VII of
the Act.
