On November 29,
1990, the Board granted to USX Corporation
(USX)
a six month extension of
time
in this site-specific
rulemaking because
USX
was advised that U.S. EPA would reopen its
delisting file in this matter.
In response to a Board Order of
February
7,
1991, USX filed a timely status report,
on April
8,
1991,
stating that the “delisting petition has been reviewed by
the
U.S.
EPA’S) Law Department and has been forwarded for
signature.”
The report further states that USX “could expect to
see the US.
EPA’S final decision published in the Federal
Register within the month of April 1991.”
The extension of time granted in November expires on May 29,
1991.
The Board directs USX to
file appropriate motions with the
Board by May 20,
1991,
indicating what action USX is requesting
the Board to take.
