ORDER OF THE BOARD

This matter
is before the Board on a status report requested
by the Board on June 21,
1990.
Both parties filed a status
report with the Board,
the Respondent on July 17,
1990 and the
Petitioner on July 23,
1990.
The reports indicate that the
Petitioner
is preparing a revised closure plan
to submit
to the
Agency
in the next
four weeks.
The Respondent has previously
indicated
that
it takes approximately 60 days
to review these
types of
filings.
The Petitioner
indicated that
if the parties
come
to an agreement on the revised plan
it would alleviate
the
issues raised by this appeal.
However, the Petitioner also
indicated
that proceeding
to hearing on the issues
raised in this
appeal would not be necessary even if an agreement
is
not
reached.
The Petitioner indicated that they “will likely want
to
request
that the Board remand this matter
to the Agency”
if an
agreement
is not reached.
Therefore, the Board directs
the
parties to submit
a status report
to be received by the Board
no
later than November
7,
1990,
indicating when this matter should
be set for hearing.
