1990, the City of Morris
(“Morris”)
filed
a
Petition for Variance, seeking relief from
35 Iii. Adm.
Code
602.105(a),
“Standards for Issuance”,
and 35
Ill.
Adm.
Code
602.106(b),
“Restricted
Statustt.
The Petition is deficient
insofar as there is no request for hearing, nor statement waiving
hearing, accompanied by such affidavits or other proof
in support
of the material facts alleged in the Petition (see
35 Ill.
Adm.
Code 104.124).
If an amended petition curing the above-noted
defect is not filed within 45 days of the date of this Order,
this matter will be subject to dismissal.
The Board also requests Morris to elaborate on the type of
radium removal system that it plans to install.
Specifically,
the Board believes that it would be helpful for Morris to provide
information on the technology, efficiency, manufacturer,
cost,
and the other locations where such technology
is employed.
Finally, the Board requests Morris to file a copy of Construction
Permit No.
l623—FY1989 and a copy of the Notice of Award-Notice
to Proceed Agreement,
both of which are referred to at page 11,
paragraph 25(1)
and
(2)
of the Petition.
