The case filed by IEPA
(PCB 89—87) has
a filing date of May
19,
1989.
It
is now almost
15 months old.
That seems an ample
time
in which to
(a) arrive at a settlement or
(b)
go to hearing
on the merits.
I would order
these
cases
to hearing after receipt
of the
October
9,
1990 status report.
By that time,
these cases will be
17 months old and will still require
a hearing and briefs before
being completed.
There
is an old saying that fits here.
“Justice delayed is justice denied.”
For these reasons,
I concur.
