CODE 216.381 FOR FERROUS

(Rulemaking)
FOUNDRIES IN VERMILLION COUNTY
)
ORDER OF THE BOARD
(by
B.
Forcade):
This matter
is before the Board
on a November 26,
1990,
motion for extension of
time filed by petitioner General Motors
Corporation
(“GMC”).
On October
11,
1990,
the Board issued an
order findino that GMC’s petition for site—specific rulemaking
was deficient,
in that
it did not address the questions contained
in the Analysis of Economic and Budgetary Effects questionnaire,
and did not meet the requirements
for incorporation by reference
of prior preceedings.
The Board allowed GMC 45 days, that
is,
until November
26,
1990,
to cure these deficiencies.
GMC seeks
an extension of that deadline, until
December 21,
1990,
to
supplement
its site—specific rulemaking petition.
In support of
its request, GMC states that
it did not
receive
a copy of the October
11,
1990 order until the week
of
October
29,
1990.
GMC also states that it has obtained the
record of the prior proceeding which
it wishes
to incorporate,
and that
it
is working
to address the questions on the economic
effects questionnaire.
GMC’s motion for extension of
time is granted.
The Board
notes that the seven day period
to respond
to this motion has not
run.
However,
the Board finds that undue delay would result
if
it does not rule on the
today.

Code 101.241
