This matter
comes
before the
Board
on
a
“Motion
to Modify
Variance”
filed September
13,
1990 by petitioner Allied-Signal,
Inc.
Allied seeks to modify an internal deadline of
the
variance
granted to Allied by the Board’s opinion and order of November
2,
1989.
In
its opinion and order granting Allied
its variance,
the
Board
imposed
a
condition
that
within
120
days
prior
to
the
termination
of the variance,
Allied
shall
submit an
engineering
evaluation
of the treatability of arsenic.
Allied states
in its
motion that this report will not be available in time to meet the
120-day deadline of October
20,
1990 and asks that
it be granted
an
extension
of
time to
file the
report
on
November
13,
1990.
Allied notes that this extended deadline would make the report due
90 days prior to the end of the variance.
Allied also states that
the Agency has been notified of the motion and does not object to
the extension.
The
motion
to
modify
the
internal
deadline
set
forth
in
paragraph
2
of
the
Board’s order
of
November
2,
1989
is
hereby
granted.
The
November
2,
1989
order
is
modified
so
that
the
engineering
evaluation
is
now
due
to
be
filed
no
later
that
November 19,
1990.
