ORDER OF THE BOARD

This petition filed November
20,
1990, seeks an adjusted
standard pursuant to, alternatively,
35
Ill. Adm. Code 724.213(e)
or 725.213(e)
of the Board’s RCRA rules as they relate to future
operation and ultimate closure of an emergency holding lagoon.
The petition was accompanied by a motion for leave to
file
a
single copy of voluminous technical documents.
The motion is
hereby granted.
The Board notes that Olin filed proof of publication on
December 19 pursuant
to 35
Ill. Adm. Code 106.712, and that Olin
has requested a hearing
in this matter, although it believes that
various issues can be resolved by negotiation with the Agency.
The Board further notes
that, pursuant to 35
Ill. Adm. Code
106.714,
the Agency filed
a
response to the petition.
Among
other things, the response requests that the Board rule on the
petition and states that the Agency does not oppose the granting
of an adjusted standard.
The Agency does not, however, state
what terms and conditions any adjusted standard should contain.
Under these circumstances, the Board cannot rule on the
petition until a hearing has been held,
and declines to rule on
the petition until
receipt of
a more detailed response from the
Agency.
The Board accordingly requests that the Agency file an
amended response
in this matter on or before February
1,
1991.
This matter will not be scheduled for hearing until after such
response is received.
