    On January 22,
    1991, the Illinois Environmental Protection
    Agency (Agency)
    filed a motion to dismiss this matter.
    On
    February
    4,
    1991,
    the Petitioner’s response was received by the
    Board;
    however,
    the certificate
    of service indicates
    that the
    response was mailed January
    30, 1991.
    On February
    4,
    1991,
    the
    Board received a motion by the Agency requesting
    that the Board
    strike the response, because
    it was not
    timely filed.
    In the
    alternative,
    the Agency asks leave of the Board to file
    a reply.
    The Board denies the Agency motion to strike the response
    and grants the Agency leave to reply.
    The reply shall be filed
    by February 22,
    1991.
